Commercial Contract Disputes

Having started our careers in large, prominent law firms representing all manner of Fortune 500 companies and industries, there are very few areas of commercial contracts we have not had involvement in one context or another.

From obtaining an arbitration award in excess of $140 million on behalf of an electric utility arising out of the bankruptcy and breach by its power trading counterparty of a multi-year tolling agreement, to a dispute between a construction contractor and a leading U.S. insurer over reporting of workers compensation policy data, to actions for breach of vendor service agreements, we apply the same rigorous analysis and tenacious advocacy. That commitment to excellence applies whether our opposing counsel is a behemoth Wall Street powerhouse, a smaller regional firm, or a local sole practitioner. The following are only a few examples of our commercial contract disputes work:

  • Successful prosecution of multi-jurisdictional contract claim by a leading provider of in-room entertainment technology for the hospitality industry, and defense of counterclaims asserted by Fortune 500 cable company alleging $9 million in damages relating to operation of system at premier luxury Las Vegas resort , including recovery in favor of our client for 100% of actual damages, plus attorneys fees.
  • Representation of medical device reseller in action for manufacturer’s breach of exclusive sales and market development agreement relating to cutting edge technology for electronic radiotherapy treatment of skin cancers.
  • Recovery on behalf of minority shareholder of software consulting, quality assurance, and testing services company in excess of three times the valuation asserted by majority shareholders, plus severance, in attempted “freeze-out” and related valuation proceedings.
